Terms of Conditions
SECTION 1 - LITTER REGISTRATION
- Breeder will sign the registry for litter registration when the owner of the female applies for litter with the Stud owned by the Breeder if applicable.
SECTION 2 - RESTUD SERVICE
- Breeder will provide a return stud service to the same Queen listed in this agreement if the matings fail to produce a pregnancy.
SECTION 3 - SEMEN TRANSPORT
-In the case where sperm its shipped, any semen transportation fees and semen collection fees will the responsibility of the female owner in the case where stud semen is shipped out and the insemination did not result in a pregnancy.
SECTION 4 - NOTIFY OF FAILURE TO CONCEIVE
-In the case where the Queen fails to become pregnant with either the female being present or semen being shipped, the female owner has 70 days from the date of this contract to notify the Breeder and request a return stud service on the next heat cycle of the dam listed in this contract.
SECTION 5 - STUD AVAILABILITY
- When return stud service is granted to the dam owner, the Breeder must provide another stud if the stud in this contract is unavailable.
SECTION 6 - STUD FEE PAYMENT
-The stud fee must be paid in full before an attempt for tie/mating is allowed. If for any reason the stud fails to tie the female and the option to collect and manually insert the sperm is not utilitized , the Breeder will give the stud fee monies back immediately and before the dam owner leaves the premises.
SECTION 7 - DUAL SIRE
- The dam owner will not allow the dam to be bred by another male than the one listed in this contract unless otherwise agreed upon in writing. Failure to do so will render this contract void.
SECTION 8 - CARE OF KITTENS
-The Queen owner will not allow any Kittens as a result of this mating to be sold to retail pet stores.
SECTION 9 - LIABILITY WAIVER
- The Queen owner releases the Breeder and company and its owners/representatives from any and all liability associated with but not limited to the breeding of the Queen. This includes any accident or injury to the dam herself or any persons or animals accompanying the dam for the breeding. Queen owner waives any accident liability to the Queen even after leaving the premises where the stud is located.
SECTION 10 - DEFINITION OF A LITTER
- One live Kitten born constitutes a litter and fulfills the burden of a litter as constituted in this contract.
SECTION 11 - BURDEN OF EVIDENCE
- The stud owner / the Breeder may ask for veterinary evidence that the Queen did indeed fail to become pregnant on a prior breeding, the burden of cost will lie with the Queen owner to pay for vet tests such as an ultrasound, or x ray. Burden of delivery of Queen to the veterinary clinic will be by the Queen owner.
SECTION 12 - MUTUAL NON DISPARAGEMENT
- The Queen owner agrees not to make public negative statements or communications disparaging the Breeder or its agents, products, members, directors or officers. Public communications also include electronic platforms. The Breeder (Including its agents, members, directors and officers) agrees not to make public negative or disparaging statements or communications about the Queen Owner. This clause is not violated when statements and evidence is required in response to legal proceedings in which both parties have agreed to subject themselves to resolve a dispute outside the boundaries of this contract. Including, but not limited to, evidence supplied for court filings, depositions, and hearings.
SECTION 13 - AGREEMENT TO TERMS
- The Queen owner/representative signs this contract and agrees to all the terms laid out in sections 1-13. Queen owner/representative understands that no other agreements are meant or implied.
